Websites – websites/webshops/e owned by the Seller, such as www.mireillelab.com.
Customer – any person who, after reviewing and selecting a product or service, has registered their data and ordered a product or service.
Website user – any person who uses the website for the purpose of purchasing products advertised on it or obtaining information about a particular product.
Use of websites – accessing websites to obtain information about their content and/or to conduct online shopping.
Online shopping or Web store – making a purchase of products through a website.
Products – all products that are featured on websites and that can be purchased through the web store.
The holder of all rights to the Websites is the company Lively Roasters doo (hereinafter referred to as “Lively Roasters” or “Seller”). By using the services of the Website, the Web Store and all associated pages, services and facilities on the Websites, consumers are deemed to be familiar with these Terms of Sale (hereinafter referred to as: Terms) at all times, and to fully understand and accept them.
These Terms apply to the rights and obligations relating to the purchase of products or services via the Lively Roasters Website and Web Stores, and the rights and obligations arising from the conclusion of a Distance Selling Agreement (hereinafter: the Agreement) between the consumer as the end customer and the Seller, and are considered an integral part of such agreements, and in relation to the conditions and method of ordering products, product prices, payment methods, warranties, complaints and returns, delivery, protection of personal data confidentiality and other issues related to the use of the website and web stores.
We advise users to familiarize themselves with these Terms and Conditions before making a purchase and to check them regularly, so that they are aware of all rights and obligations.
The contract for the purchase and sale of products between the Buyer and the Seller is concluded at the moment of ordering the product.
The Buyer may only be an adult and legally capable person. The contract on behalf of and for the account of minors and persons with complete legal capacity may be concluded by their legal representatives or guardians, and persons with partial legal capacity may conclude the contract only with the consent of their legal representative or guardian. The Seller shall not be liable for any action contrary to this provision.
Website users are required to provide accurate, valid and complete personal data when filling out the registration form, and failure to do so authorizes the Seller to deny such user access to or the provision of all or part of the services offered by the Website.
The Seller is authorized, without prior notice, to change the content of these General Terms and Conditions, the range of products, their prices, other information related to the Web store, as well as all other content of the Website, which is why Website Users are obliged to review the content of the same Website each time they visit it. Failure to do so releases the Seller from any liability. The aforementioned changes shall enter into force upon publication on the Website.
The Seller is exempt from any liability for damage that may occur to devices that enable access to the Websites and data stored on the same devices when using the Website if such damage is caused by illegal actions of third parties, computer viruses, etc., and other cases for which the Seller is not responsible. The Seller is also exempt from any liability in the event of circumstances that prevent the use of the Website.
Lively Roasters places all materials, photos and text on the website in good faith to facilitate the customer’s choice when shopping. Lively Roasters does not guarantee that the product photos fully correspond to the appearance of the product itself. We are not responsible for possible unintentional errors in the product description. All descriptions are regularly and thoroughly checked.
Online purchases can only be made if the buyer enters the correct requested information in the space provided on the Websites. When filling out the form, the buyer is obliged to provide accurate, valid and complete personal information. These Terms and Conditions, as well as certain terms of sale indicated with information about certain products, represent an offer by Lively Roasters for the conclusion of a Contract, and the user, as the buyer, by completing the form and concluding the order or in another manner specified in these Terms and Conditions, accepts them, which is considered to be the conclusion of a contract between the buyer and the Seller, according to the terms of sale specified in these Terms and Conditions.
The subject and commercial purpose of the Agreement is the purchase of the selected product through the Website and the Web store with the payment of the appropriate fee – the price of that product. The contract is concluded by means of remote communication (Contract concluded at a distance) through: internet order-web shop, printed promotional messages with purchase order, telephone with human mediation.
The Buyer is authorized to choose the option for the Seller to inform him/her about new products, products on sale, etc. (newsletter). After successfully completing the registration (all required information has been correctly filled in), a notification of successful registration will be delivered to the Buyer’s e-mail.
Products available for purchase are advertised on the Websites, and product descriptions and product prices are listed next to each product.
The selection of the desired product is done by saving it in the “basket” by clicking on the “Add to cart” link. If the Buyer purchases a product that has, in the meantime, been sold, then the Seller will contact the Buyer to agree on further action (refund of the amount paid, purchase of another product or delivery of a product of the same type when the Seller obtains it from its suppliers). The Seller, except for the obligation just mentioned, is not liable to the Buyer in the described case on any basis.
The “basket” contains all the products that the Buyer has selected for purchase, along with the product price, shipping price, and total price (including VAT). If the Buyer wishes to continue shopping, he selects the “Proceed to payment” link, and the system automatically takes him to the “Checkout” page, where he must enter customer information and delivery address.
After completing the above steps of the web store and selecting “Order” on the “Checkout” page, the system automatically takes the Buyer to the “Order Confirmation” page, which contains information about the order number, payment, as well as a notification about sending a confirmation email containing an offer to sell the selected products, as well as a notification about the email address and toll-free phone number through which the Buyer can obtain all necessary information.
If the shipment is damaged in transit, such damage is visible upon receipt of the shipment, in which case we ask the Buyer not to accept the shipment. If the Buyer discovers the damage after opening the shipment, please keep the original packaging and submit a report to the email: info@livelypharm.com so that we can check the condition of the shipment and send a new one as soon as possible. In accordance with the Consumer Protection Act, the Buyer is authorized to unilaterally terminate the contract without giving reasons within 14 days from the date of delivery of the product and, in accordance with Article 77, paragraph 5 of the Consumer Protection Act, is responsible for any decrease in the value of the purchased product resulting from handling the purchased product in the following percentages:
Product prices are retail. Product prices and delivery prices are expressed in euros and include applicable VAT. The Seller updates the displayed prices on a daily basis, which is why there is a possibility that prices in physical stores may differ from prices on the Website’s Web Store.
The Seller is authorized to change prices without prior notice, just as it is authorized to change prices exclusively for the web shop without prior notice. Also, the Seller is authorized to determine discounts, daily or weekly promotions, promotions for a single product, group of products and/or for all products, as well as for a specific payment method at any time without prior notice. The aforementioned benefits may be exclusive to web shopping, which will be indicated to the buyer before the purchase.
The price is determined for each individual product. The process of entering the price on the website for each product is subject to control at several levels, but regardless of this, there is a possibility of error due to the human factor. Such situations are exceptional and Lively Roasters apologizes to its customers in advance. Lively Roasters will be forced to inform customers about the situation, the incorrect price and the inability to deliver the ordered product with the wrong price for a specific order.
Payment for ordered products can be made in the following ways:
When payment has been made and is visible (by taking delivery after payment to the courier service employee), the purchase contract is considered to have been concluded.
When paying by cash on delivery, the order is paid in the exact amount to the courier service employee when picking up the package.
When paying on our web store, use CorvusPay – an advanced system for secure online payment card acceptance.

Payment details are transmitted encrypted from your web browser to the bank that issued your card. Our store never comes into contact with the complete details of your payment card. Also, the data is inaccessible even to CorvusPay system employees. The isolated core independently transfers and manages sensitive data, keeping it completely secure.
The payment data entry form is secured with the highest level of security SSL transport encryption. All stored data is additionally protected by encryption, using a cryptographic device certified according to the FIPS 140-2 Level 3 standard. Corvus Info considers all collected information to be bank secrecy and treats it accordingly. The information is used exclusively for the purposes for which it is intended. Your sensitive data is completely safe, and its privacy is guaranteed by the most modern protection mechanisms. Only the data necessary to perform the work in accordance with the prescribed demanding procedures for online payments is collected.
Security controls and operational procedures applied to our infrastructure ensure the current reliability of the CorvusPay system. In addition, by maintaining strict access controls, regular security monitoring and in-depth checks to prevent network vulnerabilities, and planned implementation of information security provisions, they permanently maintain and improve the level of system security by protecting your card data.
All payments will be made in Croatian kuna. The amount for which your credit card will be charged is obtained by converting the price from euros to Croatian kuna according to the valid exchange rate list of the Croatian National Bank.
When charging with your credit card, the same amount is converted into your local currency according to the valid exchange rate list of the card association.
As a result of the price conversion, there is a possibility of a slight difference in the amount compared to the original price displayed on our website.

The stated delivery times apply to most destinations in Croatia (for islands and smaller towns, shipments are delivered according to the courier service’s schedule). For international destinations, the estimated delivery time is 5-7 business days, although they depend on the courier service and are subject to various external influences.
Products that have been paid for in accordance with the submitted offer will be delivered to the Buyer. If you wish to arrange a suitable delivery date, please write this in the NOTE, so that we can convey your wish to the delivery service. When the shipment is processed, the Buyer will receive an email notification about the status of his shipment.
Delivery is carried out by the Seller (through its employees) or by hiring a reputable delivery (courier) service. Delivery is made to the entrance of the residential building at the desired address.
When taking over the delivered product, the Buyer is obliged to inspect the delivered product and in case of visible damage, he has the right to refuse to take over the same and to request delivery of the undamaged product.
In cases where a product different from the one he bought was delivered to the Customer, he has the right to deliver the ordered product, and if this is not possible, the Customer has the right to a refund in the amount of the product price paid, shipping costs and compensation for the costs of returning the product, and is obliged to return the wrongly delivered product.
Upon delivery, along with the purchased product, the Buyer receives all documents accompanying the product, an invoice, and a confirmation of receipt of the shipment, which he is obliged to sign. By signing the confirmation of receipt of the shipment, it is considered that the product has been received without external visible damage.
Delivery to a Parcelomat does not allow payment on delivery.
Delivery prices are displayed on the Websites and include the applicable VAT.
Important note for customers outside the European Union (Serbia, Bosnia and Herzegovina, Montenegro, North Macedonia):
Shipments are subject to additional customs and tax costs borne by the buyer. These costs depend on the laws of the recipient country and are not included in the product price or shipping cost.
Delivery is from Croatia, an EU member state.

For consumer disputes in relation to merchants from the Republic of Croatia, this possibility does not exist until the procedure is supported by the necessary legal regulations by the authorized bodies of the Republic of Croatia.
Based on Article 43, paragraph 2 of the Consumer Protection Act, we inform customers about the seller’s liability in the event of material defects in products when concluding distance contracts (online purchases).
In the event of damage to the contents of the shipment or the shipment does not contain what was ordered and purchased, please contact us at info@livelypharm.com without delay.
Before concluding the Agreement, the User has the opportunity to review the Terms by clicking on the link located at the bottom of the home page under “Terms of Use” (notice from Article 57, paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014)). These Terms and the notice on the User’s right to unilaterally terminate the Agreement with the form for unilaterally terminating the Agreement from Article 61, paragraph 1. and 2. of the Consumer Protection Act.
The user can unilaterally terminate the Agreement within 14 (fourteen) days from the delivery of the goods to the customer without giving any reason. The User does not have the right to unilaterally terminate the Agreement:
– if the service has been fully performed for him, and the performance has begun with his express prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Contract if the service is fully performed for him, if the subject of the Contract is goods that, due to their nature, are inseparably mixed with other things after delivery,
In order for the user to exercise the right to unilaterally terminate the Agreement, he must notify Lively Roasters of his decision to unilaterally terminate the Agreement before the expiration of the deadline by a statement sent by mail (to Lively Roasters doo, Velika cesta 99, 10020 Novi Zagreb), or by e-mail to info@livelypharm.com, in which it is necessary to state: Invoice number, invoice date, name and surname, address, telephone number, fax number or e-mail address.
If the user unilaterally terminates the Agreement, the money received from him, including delivery costs, will be refunded to him without delay, and at the latest within 14 (fourteen) days from the day Lively Roasters receives the user’s decision to unilaterally terminate the Agreement, unless the user has chosen another type of delivery, which is not the cheapest standard delivery offered. The refund will be made in the same way as the user made the payment. In the event that the user agrees to a different method of refund of the paid amount, he does not bear any costs in relation to the refund. Lively Roasters can only refund the money after the goods have been returned to him or after he has been provided with proof that the goods have been sent back.
The User is obliged to hand over the goods or send them to the address Lively Roasters doo, Vrsarska 2, 10000 Zagreb without undue delay, and in any case no later than 14 (fourteen) days from the date on which he sent Lively Roasters his decision to unilaterally terminate the Contract.
The user must bear the direct costs of returning the goods themselves. The user is requested to contact info@livelypharm.com before terminating the Agreement so that the procedure for returning the goods can be explained to him.
In accordance with Article 77, paragraph 5 of the Consumer Protection Act, the user is liable for any diminution in the value of the goods resulting from the handling of the goods, except for that which was necessary to determine the nature, characteristics and functionality of the goods.
If, at the user’s request, the performance of the service has begun during the period for unilateral termination of the Agreement, the user is obliged to pay Lively Roasters an amount proportional to what was delivered up to the moment the user notified Lively Roasters of the unilateral termination of the Agreement.

The Seller collects personal data of Customers only to the extent necessary to fulfill its obligations, to inform about new and special products and to deliver promotional materials, to improve relations with Customers, and to verify other data necessary for online shopping.
The Seller undertakes to protect the personal data of the Buyers in accordance with the General Data Protection Regulation and other applicable regulations and undertakes not to transfer personal data to third parties in any way without the Buyer’s consent. (except for data that is necessary for business partners to deliver the purchased product). This excludes cases in which the Seller, upon a valid order from authorized state bodies, is obliged to provide or allow access to the Buyer’s personal data in accordance with the law.
Lively Roasters does not record your credit card number or store transaction information. Lively Roasters uses a third-party, authorized bank to process credit card payments, which uses encryption to protect your information.
The customer has the right to request the addition, correction or modification of inaccurate personal data.
For the purposes of concluding and performing the contract, Lively Roasters has the right, pursuant to Article 6(1)(b) of the General Data Protection Regulation, to request, collect and process personal data from the User and the Customer as specified in the Privacy Policy. By concluding the contract, the Customer gives his consent to the use of the personal data thus collected for the purpose of concluding and performing the contract and guarantees that the data is accurate, complete and up-to-date.
In order for the Website pages to function properly, they must store a small amount of information (Cookies) on the user’s computer. According to EU regulations, Lively Roasters must ask for the user’s consent before storing cookies. By using the Website and the Web Store, the user agrees to the use of cookies.
By disabling cookies, the user decides whether to allow cookies to be stored on their computer. Cookie settings can be controlled and configured in the web browser that the user uses to browse the website. If the user disables cookies, there is a possibility that the site will not be able to use some of the functionalities provided by the Lively Roasters Website and Web Store.
The Seller grants the Buyers the right to use all services on the Websites only for personal, non-commercial purposes. Changing the content on the Websites, in any form, is prohibited, as is copying, public performance, etc. Using the content of the Websites on other websites is prohibited.
The Seller reserves the right to grant the rights to publish any material or parts of the Website to a third party only in the event of a concluded agreement governing the rights and obligations of the Seller and the third party publishing the information.

You agree that all matters relating to your access to or use of the Website and Web Stores and related platforms, including any disputes, shall be governed by the laws of the Republic of Croatia. You consent to the jurisdiction and venue of the courts in Zagreb and waive any objections to such jurisdiction or venue.
The preceding provision regarding venue does not apply if you are located in the European Union. If you are a consumer based in the European Union, you may bring a claim in the courts of the country in which you live. Any claim under these Terms of Use must be brought within three (3) months after the cause of action arose or such claim or cause of action is barred. No recovery for damages may be sought or received.
In the event of any controversy or dispute between Lively Roasters arising out of or relating to your use of the Website and related services, the parties will promptly, in good faith, attempt to resolve such dispute. If we are unable to resolve such dispute within a reasonable time (not to exceed thirty (30) days), either party may submit such controversy or dispute to mediation. If the dispute cannot be resolved through mediation, the parties are free to pursue any right or remedy available to them under applicable law.
