We are LIVELY ROASTERS doo , Vrsarska ulica 2, Zagreb, OIB 48618475184, and under the name Mireille Lab (hereinafter: ” Lively “, ” we “, ” our “, ” our “) we organize live and online workshops, which deal with education in the field of cosmetology and clinical aromatherapy.

These General Terms and Conditions for Participation in Workshops (hereinafter referred to as: ” General Terms and Conditions “) are intended for and apply to all participants of live and online workshops, whether you have purchased tickets yourself and are participating in the workshop or are participating on someone else’s behalf in the workshop (hereinafter referred to as: ” participant “, ” You “, ” Your “, ” Yours “).

In addition to these General Terms and Conditions, you as a participant are also subject to, and are required to comply with, the Terms of Purchase and Use .

Tickets for participating in the workshops can be purchased online at www.mireillelab.com or in person, or at our headquarters.

If you have any questions about our workshops, as well as questions about these General Terms and Conditions, please feel free to contact us in writing at our headquarters address or by email at: info@livelypharm.com .

ACCEPTANCE OF GENERAL TERMS AND CONDITIONS

These General Terms and Conditions constitute a legally binding contract between you as a workshop participant and us (Lively) as the workshop organizer . You are also responsible for ensuring that all other persons participating in the workshop on your behalf comply with these General Terms and Conditions.

These General Terms and Conditions also constitute the entire agreement between you as a workshop participant and us (Lively) as the organizer, regarding your participation in our workshop. However, it is important to note that in addition to these General Terms and Conditions, you as a workshop participant are also subject to, and are required to comply with, the Terms of Purchase and Use .

Waiver of any provision of the General Terms and Conditions or the General Terms and Conditions in their entirety is not permitted .

Please read the General Terms and Conditions carefully before deciding to participate in the workshop, as well as before purchasing tickets to participate in the workshop.

By marking the dedicated statement as part of the payment form on the website www.mireillelab.com in the case of purchasing tickets online, as well as by purchasing tickets in person after these General Terms and Conditions have been delivered to you for review and reading, it is deemed that you have fully read and understood the General Terms and Conditions, that you are fully familiar with and agree to the General Terms and Conditions, and that you will access and participate in the workshop in accordance with them. The contract is deemed to be concluded at the moment you receive our confirmation of your ticket purchase and participation in the workshop.

We reserve the right to change these General Terms and Conditions at any time, for any reason, with or without notice. Such changes do not affect the rights and obligations arising prior to such changes . Please check the General Terms and Conditions regularly as all changes become effective on the date of publication on our website www.mireillelab.com .

If you do not agree to the General Terms and Conditions, please do not participate in our workshops.

Participation in workshops is prohibited for persons under the age of 18 (eighteen).

YOUR OBLIGATIONS AND CONDUCT AT WORKSHOPS

As a workshop participant , you are solely and solely responsible for all equipment and costs necessary to purchase tickets and participate in the workshop, as well as for travel to and from the workshop location, and accommodation for the duration of the workshop if applicable.

If you are late to the workshop due to any circumstances , we are not obliged to wait until you arrive/join the workshop to start, and we are not obliged to refund the money paid for your participation in the workshop.

While participating in a live workshop, you are required to keep your personal belongings with you at all times and under your own control . As the organizers, we are not responsible for any damage, loss or theft of any of your belongings or other items you bring to the workshop.

Any content that we make available to you in the workshops through texts, presentations, articles, brochures, leaflets, advice, answers to questions, graphics, illustrations, photographs, videos, audio sequences and others are in no way a substitute for the advice, diagnosis or treatment of your doctor in the event of any urgent medical conditions, problems or questions. In the above case, always seek the advice of your doctor or other qualified healthcare provider first and without delay.

As a participant in the workshop , you are obliged to access and participate in it in accordance with these General Terms and Conditions, as well as in accordance with applicable regulations , in particular the law of the Republic of Croatia and the European Union.

You may participate in the workshop solely for personal and non-commercial purposes.

Prohibited behaviors related to your participation in the workshop include, but are not limited to:

participation in activities that are illegal, harmful, threatening, violent, vulgar or in any other way objectionable, and which violate or threaten the rights and privacy of other participants, Lively employees as organizers or any third party associated with the workshop,
participating in activities that may result in damage to any part of the venue (location) where the workshop is being held (including outdoor areas and all interior walls, floors, equipment, etc.),
bringing any equipment or objects of a dangerous nature ,
publication, transmission, sending, exchange and any other use of materials and content that are illegal, harmful, offensive, vulgar, slanderous or in any other way objectionable, and which violate or threaten the rights and privacy of other participants, Lively employees as organizers or any third party associated with the workshop,
misrepresentation, or providing false information about oneself ,
any use of intellectual property rights in any form without the permission of the rights holder and contrary to applicable regulations ,
publishing, transmitting, sending, receiving, exchanging, downloading and any other use of any material and content from the workshop for any non-personal and commercial purpose or in any way that is not in accordance with the provisions of these General Conditions ,
photographing and/or recording the workshop, except with the express permission of Lively,
any actions that disrupt or will lead to disruption of the maintenance and implementation of the workshop ,
any actions that violate or will lead to the violation of applicable law ,
any actions that violate or will lead to violation of the provisions of the General Terms and Conditions ,
anything that in Lively’s opinion damages or could damage the reputation of Lively and its partners, clients, customers, other workshop participants and other third parties with whom Lively is connected in any way .

In the event that you, as a workshop participant, act in any of the prohibited ways, Lively reserves the right to deny you participation in the workshop at any time, without prior warning . In such a case, you will not be refunded the money paid for your participation in the workshop.

PAYMENT

The price of participation in the workshop will be listed on the website www.mireillelab.com , along with all other information about the workshop. Information about the price is also available upon request (by phone, email, live inquiry, etc.).

Prices are expressed in EUR with VAT included , unless expressly stated otherwise. We define the price for each workshop at our own discretion and decision.

The workshop can be paid for in one of the following ways:

card payment,
wire transfer payment,
cash payment (only for purchasing tickets at Lively’s premises).

CANCELLATION, POSTPONEMENT OR CHANGE OF WORKSHOP VENUE AND REFUND CONDITIONS

Applications for the relevant workshop are not subject to change, except in accordance with the conditions as set out in this title.

If you are unable to attend the workshop in person for any reason , and you have paid the price for the workshop, you can contact us at the following number 01/6535-182 or send an email to the following address info@livelypharm.com to inform us of your inability to attend and to provide us with the details of the person who will attend the workshop on your behalf. Lively will then make the change and allow the specified person to attend the workshop on your behalf.

If you are unable to find a replacement for the workshop , please notify us at least 48 hours before the workshop. In this case, we will refund the full amount paid for the workshop.

Lively reserves the right to cancel the workshop or change the date, time, and location of the workshop.

Lively will certainly strive to ensure that workshops are held on the agreed dates, at the agreed time and at the agreed place (location) , except in the case of exceptional circumstances such as illness, insufficient registered participants or other unforeseen circumstances.

In the event of a cancellation or change in terms of the date, time, and place (location) of the workshop, Lively will notify participants without delay, or as soon as possible.

In the event of a cancellation or change in the date, time, and location of the workshop, as a participant you will be able to choose between participating in an alternatively organized workshop or canceling your participation in the workshop and accepting a refund of the price paid for participation in the workshop.

In the event of cancellation or change of the date, time, and place (location) of the workshop, Lively is not obligated to and will not pay any fees and/or penalties for cancellation or changes, as well as any costs that may be incurred by participants due to cancellation or change in connection with the workshop.

Lively’s liability in connection with any cancellation or change of the date, time, and place (location) of the workshop will be exclusively limited to the price you paid for participation in the workshop, and Lively is not responsible for any resulting damages and costs.

INTELLECTUAL PROPERTY

Lively is the owner, or holder, of all intellectual property rights related to the workshop.

All materials used in and in connection with the workshop, such as presentations, texts, brochures, flyers, articles, and other textual and visual materials, and in particular formulas for making chemical formulations, represent the intellectual property of Lively.

Intellectual property rights are protected by applicable regulations of the Republic of Croatia and the European Union, as well as international regulations and treaties.

By accessing and participating in the workshop, or by accepting the General Terms and Conditions, you agree to comply with all applicable regulations regarding intellectual property, and that you will not use intellectual property rights without the permission of the rights holder and contrary to applicable regulations .

Lively does not grant you any express or implied intellectual property rights in the materials used in and in connection with the workshop, and in particular in relation to the formulas for making chemical formulations.

It is strictly prohibited without the express written consent of Lively:

ANY DOWNLOADING, STORAGE, REPRODUCTION, COPYING, DISTRIBUTION, TRANSMISSION, PUBLICATION, MODIFICATION, REVISION, PUBLIC DISPLAY OR ALTERATION IN ANY OTHER MANNER OF MATERIALS USED IN OR IN CONNECTION WITH THE WORKSHOP,
the use of illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text ,
deletion or modification of notices of intellectual property rights or other proprietary rights on materials used in and in connection with the workshop, and in particular regarding formulas for the production of chemical formulations,
use of materials used in and in connection with the workshop, and in particular in connection with formulas for the production of chemical formulations for commercial purposes, without obtaining permission from Lively .

Any use of materials used in and in connection with the workshop, and in particular in connection with formulas for making chemical formulations that is not expressly permitted by the General Terms and Conditions, violates the General Terms and Conditions and may violate applicable regulations regarding intellectual property and other rights.

DISCLAIMER OF WARRANTIES, LIABILITY AND DAMAGES

Lively and all third parties affiliated with Lively, to the fullest extent permitted by law, disclaim all warranties, whether expressed or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement and fitness for a particular purpose .

Without limiting the above, Lively and its affiliated third parties MAKE NO REPRESENTATIONS OR WARRANTIES about the following :

that the workshops are available and adapted for participants in locations outside the Republic of Croatia ,
that the workshops will be uninterrupted and error-free ,
on the confidentiality and secrecy of communication, i.e. information, data or materials transmitted via the Internet or any other form of global communication network ,
that all information, data and materials provided at the workshop are accurate, reliable and complete ,
that any disturbances or deficiencies in connection with the workshop will be immediately repaired or removed ,
that any software, service, location, server or electronic communication on which the workshop is located or with which it is connected (especially the online workshop) is in any way free of viruses or other harmful components .

To the maximum extent permitted by applicable law, Lively and its affiliated third parties are not liable for any damages (ordinary damages, lost profits and non-pecuniary damages) arising from :

Your access and participation or inability to access and participate in workshops,
cancellations, changes to the date, time and place (location) of the workshop,
damage, loss or theft of any of your belongings or other items you brought to the workshop,
any content and materials made available at the workshop ,
Your behavior or actions as a result of reaction or reliance on any content and materials published at the workshop ,
loss of rights and/or prohibition of your access and participation in the workshop ,
any conduct or content provided by third parties at the workshop, including but not limited to any defamatory, offensive or illegal conduct by other participants, employees of Lively as the organizer or third parties associated with the workshop ,
any other questions regarding the workshop and its implementation.

As a workshop participant, you agree to indemnify Lively and related third parties for any (actual) damages incurred, and to defend and hold harmless Lively and related third parties from any claims, damages, losses, costs (including reasonable attorneys’ fees) arising directly or indirectly from your breach of these Terms and Conditions, or your access to and participation in the workshop.

Any indemnity obligation under the General Terms and Conditions is perpetual, separate and independent of any other indemnities and shall survive the termination of these General Terms and Conditions in whole or in part or your termination of your use of the Website.

PHOTOGRAPHY AND VIDEOGRAPHY OF WORKSHOPS

Please be aware that our workshops are public events and that we may photograph and/or record some of them. All details regarding filming and photography will be available to you prior to the workshop, so please read them carefully.

It is strictly prohibited for you – the participants – to take photographs and record our workshops for personal, and especially non-personal and commercial purposes, except in the case of express permission from Lively . We kindly ask you not to do so without express permission from Lively, otherwise we reserve the right to deny you participation in the workshop at any time, without prior warning.

PROTECTION OF PERSONAL DATA AND PRIVACY

FINAL PROVISIONS

These General Terms and Conditions are governed by the law of the Republic of Croatia and the law of the European Union , to the extent that it is applicable taking into account the membership of the Republic of Croatia in the European Union.

Lively and the participant will attempt to resolve any potential disputes arising from these General Terms and Conditions or any changes thereto through peaceful means , and in the event that such resolution is impossible , the court in Zagreb will have jurisdiction .

If any provision of these General Terms and Conditions is or becomes invalid in whole or in part, this shall not affect the validity of the remaining provisions of the General Terms and Conditions or the General Terms and Conditions as a whole. Any invalid provision shall be replaced by a reasonable provision that is permitted by law and most closely matches the business purpose of the original provision.
