LOYALTY PROGRAM ORGANIZER

We are LIVELY ROASTERS doo , Vrsarska ulica 2, Zagreb, OIB 48618475184, and under the name Mireille Lab (hereinafter referred to as: ” Lively “, ” we “, ” our “, ” ours “) on the website www.mireillelab.com, of which the online store is an integral part (hereinafter referred to as: ” Mireille website “), we organize a loyalty program called Mireille Loyalty .

These Loyalty Program Rules (hereinafter: ” Program Rules “) regulate the loyalty program in which if you are a customer on the Mireille website and become a member of the loyalty program (hereinafter: ” member “, ” You “, ” Your “, ” Your “) you have the opportunity to collect points and enjoy benefits according to the Program Rules .

In addition to these Program Rules , you as a customer on the Mireille website are also subject to, and you are obliged to comply with, the Terms of Purchase and Use .

PUBLICATION AND CHANGE OF PROGRAM RULES, AND TERMINATION OF THE LOYALTY PROGRAM

Program rules will be published and available on Mireille’s website.

Lively, as the organizer of the loyalty program, has the right to supplement and amend the Rules of the program , and thus the conditions regarding the collection of points and the realization of benefits in the loyalty program. You will be informed about all additions and changes in a timely manner through the Mireille website. Amendments and changes to the Program Rules come into effect on the 5th (fifth) day from the date of publication. the same on the Mireille website. With the entry into force of the new (amended) Program Rules , the old Program Rules cease to be valid.

Amendments and changes to the Program Rules do not have retroactive effect, so they do not affect points you have already earned.

If, as a member of the loyalty program, you do not agree with the new Rules of the program , please leave the loyalty program immediately . By withdrawing from the loyalty program, your membership in the loyalty program ends, and the existing contractual relationship between you as a member and us (Lively) as the organizer of the loyalty program is considered terminated. Please read the rules regarding withdrawing from the loyalty program below in the subheading ” JOINING AND WITHDRAWAL FROM THE LOYALTY PROGRAM “.

By continuing your membership in the loyalty program, i.e. if you have not withdrawn from the loyalty program within 5 (five) days from the publication of the amended and amended Program Rules , it is considered that you agree with the amendments and amendments.

Lively, as the organizer of the loyalty program, has the right to terminate the loyalty program at any time without explanation. Members will be notified of the termination no later than 30 (thirty) days before the termination of the loyalty program through the Mireille website. In this case, upon termination of the loyalty program, Lively is released from all obligations towards members (points and benefits can no longer be collected or used).

ACCEPTANCE OF GENERAL TERMS AND CONDITIONS

The rules of the program contain general conditions that represent a legally binding contract between you as a member of the loyalty program and us (Lively) as its organizer.

The mentioned general conditions also represent the entire contract between you as a member of the loyalty program and us (Lively) as the organizer of the same, and regarding your membership in the loyalty program. However, it is important to note that, in addition to the above, you, as a member of the loyalty program / customer on the Mireille website, are also subject to, and are obliged to comply with, the Terms of Purchase and Use .

Waiver of any provision of the Program Rules or the Program Rules in their entirety is not permitted .

Please read the Program Rules carefully before deciding to join the loyalty program.

By marking the dedicated statement as part of the registration form for joining the loyalty program, it is considered that you have fully read and understood the Program Rules , that you are fully familiar with and agree with the Program Rules , and that you will access and participate in the loyalty program in accordance with them. The contract is considered concluded at the moment of completing the registration, i.e. at the moment of joining the loyalty program.

If you do not agree with the Program Rules , please do not join our loyalty program.

Membership in the loyalty program is prohibited to persons under the age of 18 (eighteen).

MEMBERSHIP AND WITHDRAWAL FROM THE LOYALTY PROGRAM

Collecting points and using benefits in the loyalty program is possible only after your membership in it , and in accordance with the Program Rules .

Membership in the loyalty program is free, and is done by filling out the registration form on the Mireille website . By filling in the requested data in the registration form, you create your user account and become a member of the loyalty program. Only natural persons can become members.

In order to join the loyalty program, we need the following information from you: username, email address, your date of birth, and you need to create a unique password to access your account. All data you provide when joining the loyalty program must be true, accurate and complete. In the event that your data changes after membership, please inform us of the changes and provide us with new, updated data. Lively, as the organizer of the loyalty program, is not responsible for the truthfulness, accuracy and completeness of your data. Lively, as the organizer of the loyalty program, is not responsible for any damage that may result from possible abuses related to the provision of untrue, inaccurate and incomplete data.

Lively, as the organizer of the loyalty program, has the right to reject your request to join the loyalty program if you provide us with untrue, incorrect and incomplete information when joining or if you have already been excluded from the loyalty program due to violation of the Program Rules or other prohibited behavior.

After providing the information necessary for membership in the loyalty program through the registration form, you automatically create your user account and become a member of the loyalty program.

Membership in the loyalty program is not transferable.

You can withdraw from the loyalty program at any time, which will terminate your membership in the loyalty program. It is possible to withdraw from the loyalty program by deleting your user account and related data using the control panel of your user account – / my profile / account details /.

Also, Lively, as the organizer of the loyalty program, can exclude a member from the loyalty program in case of violation of the rules of the program , as well as in case of any prohibited behavior of the member that violates or endangers the rights, privacy and interests of others and Lively as the organizer.

After leaving or being excluded from the loyalty program , you cannot collect points or use the benefits of the loyalty program.

After you leave the loyalty program, you can always rejoin our loyalty program. In that case, the points and benefits from your previous membership will no longer be valid.

After withdrawal or exclusion from the loyalty program, we delete your personal data within one month from the date of withdrawal or exclusion.

COLLECTING POINTS AND RECEIVING BENEFITS

As a member of the loyalty program, you collect points when you purchase products on the Mireille website, and in accordance with the provisions of these Program Rules . Points can only be collected when purchasing raw materials, packaging, Gesha products, Altho products and Lively Roasters coffee, not when purchasing other products on the Mireille website.

Points are collected for a single purchase. Points cannot be purchased and are not transferable.

Points are collected in such a way that 1 EURO spent on a purchase means 1 point collected (point system).

Points are recorded, and you can monitor your points balance on your account dashboard – My Mireille Loyalty .

Points are valid for one year from the date of purchase on which they were earned , and are then deleted if not redeemed within the specified period. When redeeming points for one of the benefits, the oldest points are taken into account first.

Benefits are achieved in the following way:

  • in exchange for 300 points, the member receives a promo code for a 15% discount on the entire order ,
  • in exchange for 400 points, the member receives a promo code for a 20% discount on the entire order ,
  • in exchange for 5000 points, the member receives a promo code for a 25% discount on the entire order ,

Loyalty program benefits can only be used when making purchases in your own name and for your own account.

Loyalty program benefits are not transferable.

ADDITIONAL WAYS TO GET BENEFITS – REFERRAL PROGRAM

The Loyalty program has the possibility of an additional way of obtaining benefits – the referral program.

A referral program is a program in which a member of the loyalty program invites a person who is not a member of the loyalty program to become a member of the same, and in doing so they receive benefits.

Each member of the loyalty program receives a unique referral code , which the member can find on their account control panel – My Mireille Loyalty .

Each member of the loyalty program can share his referral code with a person who is not yet a member of the loyalty program through the selected communication channel.

A person who is not yet a member of the loyalty program receives a code from the member and enters it in a dedicated place during his membership in the loyalty program. Only one referral code can be entered.

After joining the loyalty program with the referral code received, with the first purchase of a minimum amount of 50 EUR on the Mireille website, the new member and the member who shared the referral code with them receive a 15% discount.

A member of the loyalty program can invite a maximum of 5 (five) new members via the referral code.

ERRORS, IRREGULARITIES AND COMPLAINT RESOLUTION

Loyalty program members may request correction of points that have been awarded or not awarded in error by contacting loyalty@lively.hr . The request for correction of points must be submitted without delay, i.e. immediately upon discovery of the error. The request for correction must be explained in detail, and it is necessary to provide all data and documents supporting the request.

A loyalty program member can always submit a written complaint regarding the loyalty program in the following manner:

  • to the address of our headquarters: LIVELY ROASTERS doo, Vrsarska ulica 2, 10000 Zagreb;
  • to the email address: loyalty@lively.hr .

After receiving your written complaint, we will provide you with a confirmation of receipt as soon as possible.

When submitting a written complaint, the loyalty program member is required to explain it in detail and make available all data and documents supporting the complaint.

Lively, as the organizer of the loyalty program, in the event that it does not have sufficient data and documents necessary to resolve the complaint, may ask the member of the loyalty program who submits the complaint to submit additional data within a certain period. In the event that the member of the loyalty program does not submit the requested information in a timely manner, and because of this the complaint cannot be resolved, Lively can reject the complaint.

Lively will provide the loyalty program member with a written response to the complaint within fifteen (15) days of receiving the complaint.

In the event that the member of the loyalty program and Lively as the organizer of the loyalty program cannot reach an agreement regarding the resolution of the written complaint, the member of the loyalty program can always seek protection before the competent authorities.

YOUR OBLIGATIONS AND CONDUCT

As a member of the loyalty program , you are solely and solely responsible for all equipment and costs necessary to participate in the loyalty program, or for accessing and using the Mireille website.

As a member of the loyalty program , you are obliged to access and participate in it in accordance with these Program Rules , as well as in accordance with applicable regulations , in particular the laws of the Republic of Croatia and the European Union.

You may participate in the loyalty program solely for personal and non-commercial purposes.

Prohibited conduct in connection with your participation in the loyalty program includes, but is not limited to:

  • participation in activities that are illegal, harmful, threatening, violent, vulgar or in any other way objectionable, and which violate or threaten the rights and privacy of others,
  • publishing, transmitting, sending, exchanging and any other use of materials and content that are illegal, harmful, offensive, vulgar, slanderous or in any other way objectionable, and which violate or threaten the rights and privacy of others,
  • misrepresentation, or providing false information about oneself ,
  • any use of intellectual property rights in any form without the permission of the rights holder and contrary to applicable regulations ,
  • publishing, transmitting, sending, receiving, exchanging, downloading and any other use of any material and content from the website for any non-personal and commercial purpose or in any way that is inconsistent with the provisions applicable to the relationship between Lively and You ,
  • transmit materials and data that contain software viruses, malware, ransomware or any other harmful program or computer code designed to adversely affect the operation of any software or hardware or other equipment,
  • any actions that violate or will lead to violation of the functionality of the website, and thus the functioning of the loyalty program,
  • any actions that violate or will lead to the violation of applicable law ,
  • any actions that violate or will lead to violation of the provisions of the Program Rules ,
  • everything that, in Lively’s opinion, damages or could damage the reputation of Lively and its partners, clients, customers, other loyalty program members and other third parties with whom Lively is connected in any way .

In the event that, as a member of the loyalty program, you act in any of the prohibited ways, Lively has the right to exclude you from the loyalty program at any time, without prior warning . In doing so, Lively may take all necessary and permitted actions to deny access to Mireille’s website, i.e. its functionalities.

PROTECTION OF PERSONAL DATA AND PRIVACY

FINAL PROVISIONS

These Program Rules are subject to the laws of the Republic of Croatia and the laws of the European Union , to the extent applicable taking into account the membership of the Republic of Croatia in the European Union.

Lively and members of the loyalty program will try to resolve all possible disputes arising from the Program Rules or their changes amicably , and in the event of the impossibility of such a resolution , the court in Zagreb will have jurisdiction .

If any provision of these Program Rules is or becomes invalid in whole or in part, this shall not affect the validity of the remaining provisions of the Program Rules or the Program Rules as a whole. Any invalid provision shall be replaced by a reasonable provision that is permitted by law and most closely matches the business purpose of the original provision.
